Section 781 of P.L. 119-37 redefines hemp on a total THC basis that includes THCA, and caps finished consumable hemp products at 0.4 milligrams of total THC per container. On August 8, 2026, the Senate passed a continuing resolution that would push most of the redefinition to December 11, 2026, and the administration has signalled support for that language. The House has not adopted the same provision, so the two chambers still have to reconcile before December 11 becomes the operative date.
One part of the change does not move under either version. Cannabinoids that cannot be naturally produced by the cannabis plant lose hemp status on November 12 regardless of the extension, which covers a range of conversion-derived compounds.
