Is THC legal in Texas?
Yes, one form of it. As of August 11, 2026, hemp-derived Delta-9 THC is legal to buy and possess in Texas for adults 21 and over, provided the product contains 0.3 percent or less Delta-9 THC by dry weight under Tex. Ag. Code §121.001. Delta-8, Delta-10, and THC-P are Schedule I controlled substances. Marijuana-derived THC remains illegal outside the Texas Compassionate Use Program.
The confusion most Texans have right now comes from the fact that “THC” is not one legal category. Texas treats hemp-derived Delta-9 and manufactured THC isomers as entirely different things, and the July 31 rule change moved a large group of products from the first bucket into the second without touching the first.

Did Texas ban THC?
Texas banned most THC, not all of it. On July 31, 2026, the Texas Department of State Health Services began enforcing the reinstated 2021 controlled-substance definitions published at 51 TexReg 4597 on July 10, 2026. Those definitions classify Delta-8, Delta-10, THC-P, and other non-Delta-9 isomers as Schedule I. Hemp-derived Delta-9 THC was not included and remains legal.
The path there ran through the courts rather than the Legislature. DSHS first tried to schedule Delta-8 in 2021 and was blocked by an injunction obtained by hemp producer Hometown Hero. On May 1, 2026, the Texas Supreme Court decided Texas Department of State Health Services v. Sky Marketing Corp., No. 23-0887, upholding the agency’s authority and dissolving that injunction. The rules were published in the Texas Register in July and took effect at the end of that month.

Because this was agency rulemaking rather than legislation, it remains the subject of continuing litigation, and the next regular legislative session convenes in January 2027.
Is Delta-9 legal in Texas?
Yes. Hemp-derived Delta-9 THC is legal in Texas for adults 21 and over when the finished product contains 0.3 percent or less Delta-9 THC by dry weight, the standard established by HB 1325 (86R, 2019) and codified at Tex. Ag. Code §121.001. The July 31, 2026 DSHS reclassification did not amend that definition. Delta-9 was the notable survivor of the rule change.
This surprises people, because Delta-9 is the primary intoxicating compound in cannabis and sounds like it should be the more restricted one. The answer is definitional rather than pharmacological. The reinstated DSHS schedule reaches manufactured THC isomers and variants, meaning compounds typically produced by chemically converting CBD in a laboratory. Naturally occurring Delta-9 falling inside the §121.001 hemp definition sits outside that schedule. The conversion process was the target, not the molecule.
There is a second point that determines whether a legal product is a meaningful dose. The 0.3 percent figure is a concentration limit measured by weight, not a milligram cap per serving or per package. Texas statute imposes no separate per-serving ceiling on hemp Delta-9. A larger gummy carries more total weight, so a 40mg piece can remain compliant hemp while a much smaller piece at the same milligram load would not. Does HEB carry THC drinks?
Some Texas grocery and convenience retailers stock low-dose hemp THC beverages, but selection is limited and inconsistent by location. Are THC vapes legal in Texas?
No. Retail sale of hemp-derived vapes, pens, cartridges, and disposables is prohibited in Texas regardless of which cannabinoid they contain, under Tex. Because raw flower commonly tests above 20 percent THCA, most product exceeds the limit under that calculation. The rule has been paused and reinstated repeatedly through Travis County litigation, Cause No. D-1-GN-26-002511.

Cost per 10mg of labeled Delta-9 is the accurate comparison, not sticker price. What happens to hemp THC on November 12, 2026?
Section 781 of P.L. 119-37 rewrites the federal definition of hemp effective November 12, 2026. It replaces the Delta-9-only measurement at 7 U.S.C. §1639o with a total-THC standard calculated as Delta-9 plus 0.877 times THCA, and caps finished consumable hemp products at 0.4 milligrams of total THC per container. Not per serving. Per container.
For scale, a single 10mg gummy is 25 times that limit, and a 400mg pack is a thousand times it. Every product listed in this guide, along with effectively every hemp Delta-9 gummy and seltzer sold in the United States today, falls outside the federal hemp definition on that date.
The provision was enacted in the November 2025 continuing appropriations act rather than a standalone farm bill. Several measures to repeal, delay, or amend it have been introduced in Congress. None has passed as of August 11, 2026. Until one does, November 12 is the operative date.
What should a first-time buyer start with?
Start at 5mg or 10mg and wait a full two hours before taking more. Onset for edibles is commonly reported in the 30 to 90 minute range, and stacking doses inside that window is the most common reason people end up uncomfortable. Response varies with tolerance, body composition, and whether you have eaten.
